How stepparent adoption works in Louisiana

In Louisiana, stepparent adoption is a legal avenue for blending families and solidifying relationships.

While it may seem complex, breaking down the steps can provide clarity for those navigating this important journey.

Initiating the process

Although 28% of homes had single parents in 2020, 71% still had two parents, according to the U.S. Census. However, many of these households had stepparents, some of whom sought to adopt their stepchildren. The first step in the stepparent adoption process involves obtaining the petition for adoption, consent and financial statement forms from the Family Court in the parish where you reside.

Gaining consent

Obtaining consent from the noncustodial parent is an important aspect of the adoption process. The noncustodial parent needs to willingly terminate his or her parental rights for the adoption to proceed smoothly. If they are unreachable or unwilling to provide consent, additional legal procedures may be necessary.

Home study

A home study evaluates you and your home’s suitability for the adopted child. This assessment includes interviews, home visits and background checks to ensure a stable and nurturing environment for the child.

Filing the petition

File the adoption petition with the Family Court. Include all required documentation, such as the birth certificate of the child, consent forms and the results of the home study. Pay close attention to detail to prevent delays in the process.

Finalizing the adoption

Upon approval of the petition, a court date will be set for the finalization of the adoption. During the hearing, the judge will review the case, ensuring that you meet all legal requirements. If satisfied, the judge will issue an adoption decree, legally solidifying the stepparent’s relationship with the child.

For better results, you need to show that the adoption is in the child’s best interest.
